Kugler Kandestin obtains $1M+ judgment against Costco, including $500,000 in punitive damages

In a judgment dated November 22, 2017, the Superior Court of Québec rendered a decision in favour of our client, Simms Sigal & Co. Ltd., against Costco Wholesale Canada Ltd. in excess of $1,000,000 (including interest).

Of particular significance is the awarding of $500,000 in punitive damages by the Court following its finding that Costco showed a “conscious and callous disregard for [Plaintiff’s] reputation”, which was “compounded by the lack of any remorse.”

The Court decided that the $500,000 award – which is noteworthy by Québec standards – was “sufficient and appropriate to fulfill the preventive purpose” of punitive damages, as set out in Article 1621 of the Civil Code of Québec.
